1. Emergency Services Only โ No Warranty
All services provided by Georgetown Roadside Rescue (operated by Israel Conde) are emergency roadside assistance measures only. Services are provided "as-is" and "as-available" with no warranty, guarantee, or representation of any kind, express or implied, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, or workmanlike performance. Georgetown Roadside Rescue does not guarantee that any service will permanently resolve the mechanical or operational issue affecting your vehicle.
2. Assumption of Risk
By requesting and receiving services, the customer knowingly and voluntarily assumes all risks associated with the emergency situation, including but not limited to risks arising from proximity to moving traffic, highway or roadside conditions, weather, the condition of the vehicle, and the temporary nature of the service rendered. The customer acknowledges that roadside environments are inherently dangerous and accepts full responsibility for their own safety and the safety of any passengers.
3. Release, Waiver & Hold Harmless
In consideration of receiving services, the customer hereby knowingly and voluntarily releases, waives, indemnifies, and forever holds harmless Georgetown Roadside Rescue and Israel Conde from any and all claims, demands, causes of action, damages, losses, costs, or expenses of any kind โ whether known or unknown, in tort, negligence, contract, statute, or otherwise โ arising out of or related to the services provided. This includes but is not limited to: personal injury, death, property damage, vehicle damage, mechanical failure, loss of use, emotional distress, punitive damages, incidental damages, and consequential damages.
4. No Liability After Service
Georgetown Roadside Rescue is not responsible or liable for any accident, injury, property damage, mechanical failure, breakdown, or any other incident that occurs after services have been rendered and the service provider has departed. The customer accepts full responsibility for the continued operation of their vehicle following service. Jump starts, tire plugs, and fuel delivery are temporary emergency measures โ not permanent repairs. The customer is solely responsible for seeking professional mechanical inspection and repair at a licensed auto shop after receiving any service.
5. No Liability for Pre-Existing Conditions
Georgetown Roadside Rescue is not liable for any pre-existing damage, wear, deterioration, or mechanical deficiency in the customer's vehicle that is discovered, worsened, or made apparent during or after the provision of services. This includes but is not limited to: corroded battery terminals, damaged tire sidewalls, stripped lug nuts, faulty door locks, broken key fobs, or any other pre-existing vehicle condition.
6. Limitation of Damages
To the maximum extent permitted by applicable Texas law, Georgetown Roadside Rescue's total liability to any customer for any claim arising out of or related to services shall not exceed the amount actually paid by the customer for the specific service rendered. Under no circumstances shall Georgetown Roadside Rescue be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, regardless of the theory of liability and even if advised of the possibility of such damages.
7. Customer Indemnification
The customer agrees to indemnify, defend, and hold harmless Georgetown Roadside Rescue and Israel Conde from and against any and all third-party claims, lawsuits, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorney's fees) arising from: (a) the customer's use of the services; (b) any accident or incident involving the customer's vehicle after service has been rendered; (c) the customer's breach of these terms; or (d) any negligent or wrongful act or omission by the customer.
8. No Mechanical Repairs or Towing
Georgetown Roadside Rescue does not perform mechanical repairs, diagnostics, or towing services of any kind. Any attempt by the customer to request services beyond those explicitly offered (jump starts, lockout assistance, tire plugs, tire changes with customer-supplied spare, and emergency fuel delivery of up to 3 gallons) may be declined at the sole discretion of the service provider. Georgetown Roadside Rescue does not supply tires, batteries, or replacement parts.
9. Governing Law
These terms and any dispute arising out of or related to services provided by Georgetown Roadside Rescue shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the courts of Williamson County, Texas.
10. Acknowledgment
By calling, texting, or otherwise requesting services from Georgetown Roadside Rescue, the customer acknowledges that they have read, understood, and voluntarily agree to be bound by all of the terms set forth above. These terms constitute the entire agreement between the customer and Georgetown Roadside Rescue with respect to the services provided and supersede all prior agreements or understandings. Rates are subject to change without notice.
